Gildan Activewear Inc. and its wholly owned subsidiaries (“Gildan”, “we” “our” or “us”) are committed to protecting the personal information they collect, use, and disclose (or “process”). This Privacy Notice (“Notice”) applies to the personal information we collect, use, and disclose when you visit our corporate website (the “Website”), or in your offline interactions with us. 

This Notice does not apply to information collected from our consumer-facing websites, which are governed by their own respective consumer privacy notices. Furthermore, this Notice does not apply to third-party companies (including, without limitation, their websites, platforms, or applications) which we do not own or control or are not acting on our behalf. These sites may have their own privacy notices and terms and conditions that you should consult.

1.   Types of information we collect

The types of information we collect depend on the nature of your interactions with us. We refer to “personal information” as information about an identifiable individual or as information that directly or indirectly allows an individual to be identified. Privacy laws around the world may use the terms “personal data” or “personally identifiable information” to refer to similar concepts.

When you use this Website, visit our offices, attend tradeshows or events, sign up for our newsletter, subscribe to receive more information about our products, use our services, or download or request any materials from our Website, we may collect the following categories of personal information.

a.    Information you provide us

•    Identifiers and contact information. If you subscribe to our newsletter or marketing campaigns (including SMS campaigns), or use the “Contact Us” button available on this Website, we will receive your contact information. Contact information may include your email address, first and last name, phone number, the reason for contacting, country and postal address, and the content you share within messages when you contact us or engage with our customer service.

•    Contact and account information. We receive and store the information you provide directly to us when you sign up or create an account with us in connection with your review of our products or marketing materials, your participation in contests and sweepstakes, or when you respond to a survey. The types of information we may collect directly from you include first and last name, date of birth, demographics such as age or gender, email address, mailing address, telephone number, job title, country, postal address. 

We do not collect sensitive personal information. We are not in control if you choose to voluntarily provide other personal information to us that we do not request and in such instances, you are solely responsible for such information.

b.    Information we collect automatically on our Website
When you visit this Website, we and our service providers or third parties, use cookies, web beacons, Flash cookies, and similar technologies to collect information when you interact with our Website or applications. This information may include pages visited, referring web address, browser type, device details, items viewed, search history, IP address, search terms, and device location. •    Career opportunities – If you apply for  job opportunities at Gildan via our Careers section, you may need to create an account. We may also collect information you send to us via other means, such as email or another job application platform. We use this information to process and respond to your application for employment or related inquiry.

•    For security and compliance reasons – We may use your personal information to: (i) notify you of updates, security alerts, and information regarding changes to our policies; (ii) fulfil our legal and compliance-related obligations; (iii) enforce this Privacy Notice or the Website Terms of Use; and (iv) prevent and address fraud and threats of harm.

•    Contractual and legal purposes – We use personal information to carry out our obligations and enforce our rights under contracts, including for billing or to comply with legal requirements.

 

3.   Legal basis for processing your personal information

In some jurisdictions, we must disclose the legal basis we rely on to process (i.e., collect, use or disclose) your personal information. We generally rely on your consent to process the personal information you provide to us. Under certain circumstances, the legal basis for processing may be to fulfill our contractual obligations to you or to meet our legal obligations, such as:

4.   Disclosure of your personal information

We may disclose your personal information to the third parties below in the following circumstances:

•    Service Providers. We disclose personal information with our service providers. Service providers assist us with a variety of business functions, such as data analytics, marketing, website management and maintenance, product or service delivery, data hosting, and auditing. Service providers may use information that can’t be traced back to you (i.e., information that has been aggregated) for their own purpose, except as prohibited by applicable law.

•    Partners. We may disclose personal information with our partners in connection with offering co-branded services, selling, or distributing our products, or engaging in joint marketing activities.

•    Promotions. We disclose personal information as set out in the official rules that govern the promotion, as well as for administrative purposes and as required by law (e.g., on a winners list). By voluntarily entering a sweepstake, contest or promotion, you agree to the official rules of that promotion, and may, except where prohibited by applicable law, allow the sponsor and/or other entities to use your name, voice and/or likeness in advertising or marketing materials.

•    Affiliates. We disclose personal information with our related entities including our parent and affiliated companies for purposes such as customer support, marketing, and technical operations. 

•    Business Transactions. We may disclose your personal information as part of a potential business transaction to the other party (including as part of the due diligence process).

•    Legal Counsel. We may disclose personal information to our legal counsel.

•    Law Enforcement. We may disclose personal information to a government institution that has asserted its lawful authority to obtain the information or where we have reasonable grounds to believe the information could be useful in the investigation of suspected unlawful activity, or to comply with a subpoena or warrant or an order made by a court, person or body with jurisdiction to compel the production of information, or to comply with court rules regarding the production of records and the disclosure of information.

 

5.   Cross-jurisdictional transfers of personal information

We operate a global business. By using our services and our Website, you understand that we may transfer some of the information we gather to another jurisdiction than the one you reside in. In addition to Canada and any of the provinces within Canada, your personal information may be collected, used, disclosed, or stored for any purpose stated in this Notice in the United States or any jurisdiction in which our service providers operate. This means we may be required to disclose your personal information to law enforcement and national security authorities under the laws of their jurisdiction.

•    Liking, Sharing, and Logging-In. We may embed a pixel or SDK on our Website that allows you to “like” or “share” content on, or log-in to your account through social media. If you choose to engage with such integration, we may receive information from the social network that you have authorized to share with us. Please note that the social network may independently collect information about you through the integration.

•    Brand Pages and Chatbots. We may offer our content through social media. Any information you provide to us when you engage with our content (such as through our brand page or via our chatbot on Facebook Messenger) is treated in accordance with this Privacy Notice. Also, if you publicly reference our website on social media (e.g., by using a hashtag associated with a Gildan entity in a tweet or post), we may use your reference on or in connection with our Website.

We are not responsible for the privacy practices or the content of these other entities and any information that you provide to such other entities, including what information they share with us, your rights and choices on their services and devices, and whether they store information in your jurisdiction of residence or elsewhere, shall be subject to the privacy policies of the owners of such other entities. 7.   Cookies and advertising services provided by third parties

We may use third parties to provide analytics services and serve advertisements on our behalf. These entities may use cookies, web beacons, device identifiers, and other tracking technologies which collect information about your use of our Websites and applications. We use Google Analytics, combined with other analytics services, to better understand your use of our Website and how we can improve it. Note, however, there is no industry consensus as to what site and app operators should do with regard to these signals. We retain your personal information as long as necessary for the purpose identified when you provided the information or as otherwise required to comply with any legal obligation (e.g., to comply with applicable tax laws), resolve disputes, enforce our agreements, or as otherwise described in this Notice.

 

9.   Security and risks related to Internet

We maintain administrative, technical, and physical safeguards designed to protect against unauthorized access, use, modification, and disclosure of personal information in our custody and control. Despite such efforts, please note no data transmission over the Internet can be guaranteed to be secure. 

 

10.   Your rights over your personal information

You may be able to exercise certain privacy rights. The rights available to you depend on our reason for processing your personal information and the requirements of applicable law (i.e., your rights will vary depending on where you are located). 

Subject to certain exceptions and limits, your rights over your personal information generally include:

(i)    Access: You can request confirmation of whether we process your personal information, access it, and obtain a copy.
(ii)    Correction: You may request that we correct your personal information. Depending on the purpose of the processing, you may request that we complete the personal information we hold about you where you believe it is incomplete or outdated.
(iii)    Consent withdrawal: Where we rely on your consent to process your personal information, you may withdraw that consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to the consent withdrawal. Each promotional email contains the option to unsubscribe from our email list, in which case we will stop sending you promotional emails. If you no longer wish to receive emails from us, you may also contact us as set out under Section 13 – How to contact us.
(iv)    Erasure: You may request that we delete or de-index your personal information we have collected from you, subject to certain conditions and limitations under the law. 
(v)    Non-discrimination: You have the right to be free from discrimination related to your exercise of any of your privacy rights.
(vi)    Complain to your local data protection authority: Depending on your location, you may contact your local data protection authority. In Canada, you can contact the Office of the Privacy Commissioner of Canada or the relevant provincial privacy commissioner for your province of residence. We would greatly appreciate the chance to deal with your concerns before you approach the relevant privacy regulator, so please contact us first.

In addition, under certain specific jurisdiction’s privacy laws, you may be entitled to the following rights:

(i)    Objection to use: You can object to our processing of your personal information under certain conditions, in which case we will be required not to process your personal information.  
(ii)    Data portability: You can request to receive some of your personal information in a usable electronic format or request that we transmit it directly to a third party. 
(iii)    Opt-out of the sale or sharing of personal information: In the event that we share personal information with third parties in a manner that constitutes a “sale” as defined under applicable regulation, you can opt out of such a “sale”. 
(iv)    Opt-out of profiling: You can opt-out of automated processing of your personal information to evaluate, analyze, or predict personal aspects related to your economic situation, health, personal preferences, interests, reliability, behavior, location, or movements, to the extent this results in decisions that produce legal or similarly significant effects.
(v)    Opt-out of tracking for targeted advertising purposes: You can opt-out of tracking for targeted advertising purposes.

Please note that we may ask you for information to help us verify your identity before we can fulfill your request. As permitted under applicable law, we may require that your request: (i) provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of that person; and (ii) describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use personal information provided in a request to verify the requestor’s identity or authority to make the request. We will respond to your verifiable request within any prescribed timelines. In some cases, applicable law may require us to refuse to provide you with access to some or all of the personal information we hold about you, or which we may have destroyed, erased or made anonymous in accordance with our legal obligations to retain records and best practices for the protection of personal information.

 

11.   Children and minors on this Website

This Website or our services are not directed at children under thirteen (13) years of age. 

We do not knowingly collect personal information (as defined by the U.S. Children’s Privacy Protection Act, or “COPPA”) in a manner not permitted by COPPA. Please do not allow children under the age of 13 to provide any personal information through this Website. If we learn that a child under the age of 13 has provided personal information in violation of our Privacy Notice, we will delete that information as soon as practical and to the extent required by applicable law. Schedule A - Additional disclosures for California residents

These additional disclosures in this “California Residents” schedule apply only to individuals who reside in California. The California Consumer Protection Act (“CCPA”) provides additional rights to consumers and requires businesses collecting or disclosing personal information to provide notices and means to exercise rights.

a)    Personal Information We Collect, Use, and Disclose. We collect, and have collected in the past 12 months, the following categories of personal information enumerated in the CCPA:

•    Identifiers, including name, email address, phone number, account name, IP address, and an ID or number assigned to your account.

•    Personal information described in Cal. Civ. Code § 1798.80(e), including name, address, phone number, education, employment, employment history.

We collect and use these categories of personal information for the purposes described in Section 2 - Purposes and use of your personal information, including to provide and manage our Website, which include the following business purposes: 

•    Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards.

•    Helping to ensure security and integrity.

•    Debugging to identify and repair errors that impair existing intended functionality.

•    Short-term, transient use.

•    Performing services on our behalf, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing analytic services, or providing similar services on our behalf.

•    Providing advertising and marketing services.

•    Undertaking internal research for technological development and demonstration.

•    Undertaking activities to verify, maintain, improve, upgrade, or enhance the quality or safety of our service.

Moreover, we disclose, and have disclosed in the past 12 months, all or substantially all categories of personal information to third parties, service providers, and contractors for various purposes as further described in Section 4 – Disclosure of your personal information above.

Gildan does not sell personal information for monetary consideration but shares, and has shared in the past 12 months, identifiers, commercial information, internet or other electronic network activity information, and inferences for valuable consideration or cross-context behavioral advertising with our business partners in connection with advertising technology activities such as those disclosed in Section 7 - Cookies and advertising services provided by third parties of this Notice and in our Cookie Policy. However, we do not knowingly “sell” or “share” personal information of minors under 16 years old who are California residents.

We retain personal information as described in Section 8 – Personal Information Retention above.

b)    About your Rights as a California Resident. If you are a California resident, you may have the following rights under the CCPA:

•    Right to Know. You may have the right to request that we provide to you: 

-    The categories of personal information we have collected about you;  

-    The categories of sources from which the personal information was collected; 

-    The categories of personal information about you we disclosed for a business purpose, sold, or shared;

•    Right to Limit. We do not process sensitive personal information, as that term is defined in the CCPA. We therefore do not offer the right to limit the use or disclosure of sensitive personal information.

•    Right to Non-Discrimination. You have the right not to receive discriminatory treatment by us for the exercise of any of your rights.
